Can You Rent Your New Smyrna Beach Home on Airbnb? Here Is How the Zoning Actually Works

Every few weeks I get the same phone call. Someone found a beach cottage they love, ran the numbers on nightly rates, and wants to know how fast they can close. Then I ask what the zoning is, and the line goes quiet.

New Smyrna Beach is one of the more geographically specific short-term rental markets in Florida. Two houses on the same block can have completely different rental rights. One can legally book a three-night stay in July. The other can get a code enforcement notice taped to the door for doing exactly the same thing.

Here is how the rules actually work, and how to check an address before you write an offer instead of after.

The 30-day line is the whole ballgame

The City of New Smyrna Beach treats a rental of less than 30 days as a short-term rental. That is the trigger. Anything under 30 days is regulated. Anything 30 days or longer is generally permitted throughout the city as long as the owner holds a Business Tax Receipt.

A detail that catches people: renting once a month for a stay shorter than 30 days still counts as short term. Occasional use does not create an exemption. If you plan to rent for two weeks over the holidays and let the house sit the rest of the year, you are still operating a short-term rental under the city’s definition.

Where short-term rentals are permitted

The city permits vacation rentals in specific zoning districts, and most of them sit east of the Intracoastal Waterway on the beachside. Based on the city’s code of ordinances and its published short-term rental guidance, the permitted districts have generally included:

East of the Intracoastal Waterway

  • R-3A, east of Atlantic Avenue
  • R-4, R-5, and R-6
  • B-4
  • M-U (Mixed Use)
  • BBH (Beachside Business Historic)

East of the Intracoastal and south of 3rd Avenue

  • R-2A

West of the Intracoastal Waterway

  • M-U and BBH only

Notice what is missing. The bulk of the mainland residential neighborhoods, and a good portion of beachside residential zoned R-1 or R-2, are not on that list. If a property sits in one of those districts, a nightly rental business is not a legal use no matter how nice the house is or how close it is to the water.

Zoning districts and ordinances change. Treat the list above as a starting point for your research, not as the final word. Confirm the exact district for any specific parcel with the City of New Smyrna Beach Building Department before you rely on it.

Silver Sands and Bethune Beach are a different jurisdiction

This is the single most misunderstood point in our market.

Silver Sands and Bethune Beach sit south of the city limits and fall under Volusia County, not the City of New Smyrna Beach. City ordinances do not apply there. County rules do, and county code enforcement has historically taken the position that operating a nightly rental in a single-family residential district functions as a hotel use.

If you are shopping south of the city line, do not assume New Smyrna Beach rules carry over. They do not.

“It is already being rented on Airbnb” proves nothing

I want to be direct about this because it costs people money.

Enforcement here is complaint-driven and campaign-driven. The city has run monitoring efforts that scan listing sites to identify properties operating outside permitted zones. A property can rent quietly for years and then get flagged in a single sweep, often after a neighbor complains about parking or noise.

A live listing history is a marketing fact, not a legal finding. It tells you the previous owner rented the property. It does not tell you they were allowed to.

The same goes for a seller’s rental income statement. Income produced from a use that is not permitted is not income you can count on continuing.

The three approvals a legal short-term rental needs

Zoning is step one. Even in a permitted district, you need paperwork.

1. City Business Tax Receipt and Certificate of Use. You apply through the Building Department. Zoning gets verified as part of the review, and the city schedules a life-safety inspection of the unit. Pass the inspection, receive the Certificate of Use, then pay the Business Tax Receipt at the Finance Department.

2. State DBPR license. Florida requires a vacation rental license from the Department of Business and Professional Regulation. Single-family homes, townhouses, duplexes, triplexes and quads use the Vacation Rental Dwelling license. Individual condo units use the Vacation Rental Condo license. Florida law requires the license before you begin operating, not after your first booking.

3. Tax registration. Short-term stays in Volusia County carry both state sales tax with the local surtax and the county tourist development tax. Combined, that has run in the neighborhood of 12.5 percent on transient rentals of six months or less. Some booking platforms collect and remit portions of this automatically, but the owner remains responsible for the obligation. Confirm what your platform actually remits and what you are still on the hook for.

Condo and HOA documents can be stricter than the city

Zoning sets the ceiling. Your association can set a lower one.

A condo declaration can prohibit rentals under six months even when the building sits in a district where the city would allow weekly stays. Associations can also cap the number of rentals per year, require board approval of tenants, charge application fees, and impose minimum lease terms that make the math stop working.

Read the declaration, the bylaws, the current rules and regulations, and any rental addendum. Then read the last twelve months of board meeting minutes, because rental restrictions are one of the most common items associations vote to tighten.

Verify an address before you write the offer

Here is the sequence I run for buyers shopping specifically for rental use:

  1. Pull the parcel zoning using the City of New Smyrna Beach zoning map, or Volusia County property records if the parcel is outside city limits.
  2. Call the Building Department and confirm the district in writing, along with whether short-term rental is a permitted use at that address today.
  3. Request the association documents if the property is in a condo or HOA, and read the rental provisions before the inspection period ends.
  4. Ask for the seller’s licenses. A current Business Tax Receipt and DBPR license is meaningful evidence. The absence of them on a property marketed as a rental is worth chasing down.
  5. Build the contract around the answer. If rental use is the reason you are buying, the contract should protect you if the use turns out not to be permitted. Have that conversation before you sign, not during the inspection period.

What it costs to get this wrong

Code enforcement can issue violation notices with daily fines that accrue until the use stops. Beyond the fine, you lose the income the entire purchase was built around, and you are left holding a property that pencils out very differently than the spreadsheet you built in April.

The verification above takes a few phone calls and about a day. That is a good trade.
